Yes.  Oil Wells are exempt from enemy foundation proximity build restriction.  It is reportable for resource blocking on PvE if they build a building over it though (or even you, doesn't matter if it is by your base), same with charge nodes and Ab gas veins.  But if they just put it there, and didn't build a building on it, but kept it locked, the best you can do is talk to them and see if they'll unlock it.  Otherwise, placing an Oil Well and not unlocking it, or building a hut on it, but refreshing it every day is perfectly within the Code of Conduct.

It is bad form...  But legal.
